Article 1: Identity of the seller

Article 2: Definitions
2.1. Seller: PMU Specialist
2.2. Buyer: any natural person who, exclusively for professional purposes, acquires or uses products or services put on the market by PMU Specialist.
2.3. Consumer: any natural person who, exclusively for non-professional purposes, acquires or uses products or services brought onto the market by PMU Specialist.
2.4. Agreement : A quotation submitted by the seller shall not constitute an offer. A quotation is issued on the understanding that no agreement is concluded until the seller sends an order confirmation. The seller reserves the right to withdraw or revise a quotation at any time before accepting the order. A quotation is only valid for 30 days from the day it is issued, provided the seller has not revised or withdrawn it before that.
2.5. Goods: any product offered for sale by PMU Specialist on the website.
2.6. Website: the website of the Seller, accessible via www.pmuspecialist.com
Article 3: applicability
3.1. Unless explicitly agreed otherwise in writing in advance, these General Terms and Conditions shall apply to every offer made by PMU Specialist as a Webshop to you as a Consumer and to every Distance Agreement concluded between PMU Specialist and you as a Consumer.
3.2. To be able to place an order, you have to be at least 18 years of age. If you're not 18, we ask you to let your parents or legal guardian place the order. If we notice the order was placed by a minor, it's in our right to decline such orders.
3.3. If a Distance Contract is concluded electronically, we will provide you with a copy of the General Terms and Conditions together with the order confirmation, or at the latest upon delivery, and this in a format that you can save or print.
3.4. If, in addition to these General Terms and Conditions, specific goods or service conditions also apply and there are differences between the Additional Terms and Conditions and the General Terms and Conditions, the provisions of the Additional Terms and Conditions take precedence over the General Terms and Conditions, unless otherwise provided.
3.5. PMU Specialist reserves the right to amend and/or supplement the General Terms and Conditions at any time for future orders.
3.6. By using the PMU Specialist webshop and/or placing an order, you accept these General Terms and Conditions and all other rights and obligations as they are stated on the website.
Article 4. Order and delivery time
4.1. To purchase a product online, you must add the product to your shopping basket, after which you must enter your contact and billing details.
4.2. Online payments, Bancontact/ Mister Cash, KBC/CBC Payment Button, Belfius Direct Net, are made using secure methods. However, the Vendor can never be held liable in the event of misuse.
4.3. Our products are delivered via Bpost/DPD/Post NL. For orders within Belgium, the Netherlands and Luxembourg, the shipping costs are free starting from €175 and the delivery time is 2 to 4 working days. If your order is for less than €175, you will pay €9.95 delivery costs. The Vendor will do his best to respect the delivery times indicated. However, these deadlines are only given as an indication. Under no circumstances shall the Buyer be entitled to compensation for exceeding the delivery period.
4.4. The Buyer shall inform the Seller within 48 hours in case of damage (after receipt) and possible non-receipt of the goods. Complaints must be sent to the Seller by registered mail within 8 days of delivery. If defects in the goods are recognised, this may only lead to replacement and not compensation.
4.5. Deliveries are made to the delivery address that the Buyer indicates in his order. Products are also only delivered to the countries mentioned in our shipping list.
Artikel 5: Repossession and refund
5.1. If the Buyer wishes to cancel the purchase after delivery, it must notify the Seller in writing via email, hello@pmuspecialist.com within 5 days of purchase.
5.2. The Goods have to be returned to COMODA cosmetics BV, Oekensestraat 83c, 8800 Roeselare, Belgium. The Goods still have to be packed in their original packaging (both carton and plastic) and have to be unused.
5.3. The shipping costs for returning the products from the Buyer to the Seller shall always be borne by the Buyer.
5.4. Upon receipt of the returned, unused products, the original packaging will be checked and if there is no damage, the amount due will be transferred back to the Buyer via the same account with which the payment was made at the time of the order.
5.5. If the packaging is damaged, the Buyer will be informed via email by the Entrepreneur. The Buyer cannot then claim a refund for the products. The products will then remain at the disposal of the Buyer for 14 days at COMODA cosmetics BV, Oekensestraat 83c, 8800 Roeselare or will be sent back to the delivery address at the Buyer's request subject to the Buyer's repayment of the shipping costs to the Seller.
Artikel 6: Products and prices
6.1. The branded products sold through the entrepreneur are all original products.
6.2. The prices and offers are only valid on the day they are offered by the Seller and while stocks last.
6.3. If a product is out of stock, the Seller shall inform the Buyer thereof within 3 working days.
6.4. If a product is no longer available from our main supplier, the Buyer will be given the choice to either cancel his purchase or to have another product (of the same price) delivered. In case of cancellation, the Vendor shall return the amount due to the Buyer.
Artikel 7: Data of the buyer
7.1. By using the www.pmuspecialist.com web shop, the purchaser agrees to the collection and use of certain personal data for the sole purpose of merchandise management. These data will be included in the database of www.pmuspecialist.com
7.2. The Buyer has the right to have this personal data removed from the Seller's files at any time. To do so, he must send a request via email.
Artikel 8: Disputes
8.1. All agreements to which these general terms and conditions apply, as well as all other agreements resulting from them, shall be governed exclusively by Belgian law. The application of the Vienna Sales Convention of 11 April 1980 is expressly excluded.
8.2. All disputes between parties concerning agreements which are subject to these general terms and conditions shall fall within the exclusive competence of the courts of Ghent, section Kortrijk or the court of first instance of West Flanders, section Kortrijk.
Artikel 9: Force majeure
9.1. In the event of force majeure, the Seller shall not be obliged to fulfil its obligations. In that case, it may either suspend its obligations for the duration of the force majeure or definitively dissolve the agreement.
9.2. Force majeure is any circumstance beyond the control and will of the Seller that prevents the fulfilment of its obligations in whole or in part. We understand this to include, but not be limited to: strikes, unexpected traffic jams, accidents on European roads, fire, business interruptions, energy disruptions, disruptions in a (telecommunications) network or connection or communication systems used and/or the unavailability of the website at any time, non-delivery or late delivery by suppliers or other third parties called in.
Artikel 10: Complaints procedure
10.1. The Vendor does everything possible to satisfy its customers 100%. If you do have any complaints, you can always contact our customer service department by e-mail at hello@pmuspecialist.com or by telephone at 0032(0)51 20 24 80.
10.2. We aim to resolve any complaint or comment within 7 working days.
Artikel 11: Intellectual property
11.1. You expressly acknowledge that all intellectual property rights to information messages or other expressions concerning the products and/or the Website shall lie with PMU Specialist, its suppliers or other entitled parties.
11.2. Intellectual property rights are understood to mean patent, copyright, trademark, drawing and model rights and/or other (intellectual property) rights, including technical and/or commercial know-how, methods and concepts, whether patentable or not.
11.3. It is prohibited to make use of and/or change the intellectual property rights as described in this article.
